Mansfield offender spared from more time behind bars

Sheffield Crown Court recently heard how Benjamin Bailey, of Fritchley Court, Mansfield, admitted twice failing to comply with a suspended prison sentence relating to an assault.
But defence barrister Ian Goldsack said the suspended sentence has expired and because of time Bailey had already spent in custody on remand prior to sentencing if any further custodial sentence was imposed he would be liable for release.

Hide AdMr Goldsack added Bailey’s difficulties arose due to homelessness but he moved to Mansfield and he had struggled to make a probation appointment and then buried his head in the sand.
Judge Michael Slater told Bailey he had noted that he has been keeping out of trouble and he sentenced him to one-month in custody but this was deemed already served by time previously spent on remand.
